Competition Bureau Complaint Against Mattamy Homes

Dear sir/madam, I am filing a complaint with the Competition Bureau under Section 52 of the Competition Act. Please investigate my concerns at your earliest convenience Below are the salient points relating to my complaint

Complaint is Against – Mattamy Homes – Mill Pond, Cambridge Ontario. a development by Mattamy Homes Inc. 2360 Bristol Circle, Oakville, Ontario L6H 6M5 - (905)829-2424 – President Peter E. Gilgan
Complaint is Being Filed Under What Legislation Competition Act Section 52 - False or misleading representations 52.
(1) No person shall, for the purpose of promoting, directly or indirectly, the supply or use of a product or for the purpose of promoting, directly or indirectly, any business interest, by any means whatever, knowingly or recklessly make a representation to the public that is false or misleading in a material respect.
Competition Act Section 52(4)
General impression to be considered (4) In a prosecution for a contravention of this section, the general impression conveyed by a representation as well as its literal meaning shall be taken into account in determining whether or not the representation is false or misleading in a material respect.
Specific Details of Complaint Against Mattamy Homes.-
That Mattamy Homes in their Advertising in the Waterloo Region Record, Saturday October 11, 2008, Section H, specifically the front cover photo and text were in violation of the Competition Act Section 52 - False or misleading representations
1.The photograph on the front cover of Section H of the Waterloo Record, is not of the new Mattamy Homes subdivision but of established homes on Queen Street East, in the Hespeler part of Cambridge Ontario. This picture is not only misleading but false. Some of the homes in the photograph are over 100 years old and are definitely not Mattamy Homes. Residents in these homes (I am one of them) are extremely upset over this misleading photo. The photo of the ad has been included for the Competition Bureau to review (see links below to view ad)
2.The photograph is not a view that residents of the new Mattamy Homes will see. If the reason for the photograph was to represent the view the new Mattamy Homes residents will have from their homes, this is also misleading. As none of the homes will have this view. As directly across the river from the homes/churches(including my home) in the photograph is a factory and behind the factory are two historic homes including the Forbes Estate and grounds. No new Mattamy Homes are allowed in this area.
Three photos taken from the back of my house on Queen Street (and visible in the picture) clearly show that the Mattamy Homes subdivision is not visible across the river. The photos have been included for the Competition Bureau to review. (see links below to view photo)
3.The text on the photograph states, “Mattamy Homes’ Mill Pond”. This is not only a misleading statement but a false statement. The photo is of the Mill Pond. It is not owned by Mattamy Homes. The possessive “s” in Homes’ clearly states ownership. The Mill Pond is part of the Speed River and Grand River Watershed. If the text was referring to the subdivision, the picture should be of the subdivision.
I am requesting that the Competition Bureau investigate my complaint as per Section 52 of the Competition Act. I am requesting the Competition Bureau determine if a contravention of the legislation has taken place. If a contravention has taken place that charges be laid against Mattamy Homes as per Section 52.5.
Furthermore as per Section 52.4, it is clear to me that both the general impression conveyed by the Mattamy Homes advertisement and the literal meaning of the text in the same ad is misleading and false.
